High Court dismisses former KL Tower operator’s attempt to initiate contempt proceedings

Judge rules no interference with justice as plaintiffs’ contract had lapsed; orders Hydroshoppe and Menara KL to pay RM25,000 in costs

KUALA LUMPUR — The High Court has dismissed a bid by the former Kuala Lumpur Tower operator to begin contempt proceedings against Communications Minister Datuk Fahmi Fadzil and seven others, including the director-general of Federal Territories Land and Mines, Datuk Muhammad Azmi Mohd Zain.

Justice Roz Mawar Rozain ruled that the plaintiffs, Hydroshoppe Sdn Bhd and Menara Kuala Lumpur Sdn Bhd, failed to establish a prima facie case showing that the defendants had acted in a way that would disrupt the administration of justice or ongoing court proceedings.

She also rejected Hydroshoppe’s assertion that the defendants had encroached upon its property, noting that the company’s contract with the government had lapsed on March 31.

“The plaintiffs’ lease ended on March 31, and the government, which is a defendant in this case, has the right to reclaim possession,” the judge explained in her ruling.

Roz Mawar noted that LSH Service Master Sdn Bhd, LSH Best Builders Sdn Bhd, and Service Master (M) Sdn Bhd had been brought in under a new concession agreement.

She ordered Hydroshoppe and Menara KL to pay RM25,000 in legal costs to the respondents, including the government and the three LSH entities.

The court also dismissed Hydroshoppe and Menara KL’s application for an inter partes injunction against the government and the LSH group, stating that it was no longer relevant.

As a result, the judge ordered the plaintiffs to pay RM20,000 each in additional costs to the government and the LSH companies.

The court has fixed July 14 to hear applications by Fahmi and the three companies to dismiss the lawsuit brought by Hydroshoppe and Menara KL.

In their suit, the plaintiffs claimed that LSH Capital and its subsidiaries had induced the government to breach a prior agreement allegedly reached during a meeting in August 2022.

They requested the court to declare the concession award for KL Tower to LSH Service Master as invalid and illegal.

They also sought around RM1 billion in damages and requested that the concession be returned to them. — June 9, 2025
